PROGRAM OVERVIEW: The SKINNY COW WoCavé Instant Win/Grand Prize Drawing Game (the “Game”) starts at 12:01 a.m. PT on 5/1/2013 and ends at 11:59 p.m. PT on 6/30/2013 (“Promotion Period”). Sponsor’s computer is the official timekeeping device for the Game. Each day during the Promotion Period, participants may submit a photo of the packaging/logo of any NESTLÉ® SKINNY COW® candy product or NESTLÉ® SKINNY COW® frozen treats (referred to throughout as “Game Photo”) to play the Game. Each valid Game Photo entered is good for one (1) instant win Game Play and one (1) entry into the Grand Prize Drawing. See how to play below for details.
HOW TO PLAY: Take an original photo of your favorite SKINNY COW® brand packaging/logo as indicated above. Send photo to skinnycow@pongr.com from your computer or mobile phone. If your photo is valid (as discussed below), you will receive a unique link that you will need to click to complete your entry. Once you click the link, follow the on-screen instructions to complete your registration and play the Game. You MUST click on the unique link and follow the onscreen instructions in order to play the Game. Packaging/logo of SKINNY COW product must be the main, central focus of Game Photo, but Game Photo may include additional content. Photo must be submitted in conformity with the technical requirements (including file size) and other specifications on the website/mobile website, with such requirements/specifications being incorporated herein by reference and made a part of these Official Rules. If Game Photo is incompatible with such technical specifications for any reason, it will not result in instant win Game Play or entry in Grand Prize Drawing. Message and data charges may apply to entry via mobile phone. Participants are responsible for any charges incurred with respect thereto. Sponsor and its agencies shall have no responsibility for service interruption. Not all mobile phones will have required features to participate in the Game.
NO PURCHASE OR MOBILE PHONE USE NECESSARY. You may also obtain a photo of SKINNY COW packaging/logo for free from the internet (e.g., at www.skinnycow.com) and submit as indicated above (“free Game Photo”).
INSTANT WIN GAME: Upon clicking on the unique link after submitting your Game Photo, you will be required to enter your date of birth, e-mail, and fill out the registration form (first visit only) before you will be informed if you are a potential instant winner or not (“a Game Play”). The time of day when you play the Game during the Promotion Period, as recorded by the Game technology, will solely determine whether or not you are a potential instant winner. About Game Photos: All Game Photos become the exclusive property of Sponsor. DO NOT INCLUDE PERSONALLY IDENTIFIABLE INFORMATION (E.G., NAME, EMAIL ADDRESS OR PHONE NUMBER) IN GAME PHOTO. A Game Photo can neither name, depict, nor describe, any person, living or dead, nor can a Game Photo contain the trademark, trade name, or logo (except for the SKINNY COW brand name and/or logo), or copyrighted material of any person or entity. A Game Photo also cannot distort or modify the SKINNY COW brand packaging/logo; or disparage or otherwise adversely affect the goodwill of the SKINNY COW brand or of Sponsor. If any element of a Game Photo is determined in the sole discretion of Sponsor and/or its agencies to infringe on the rights of any third party, to be inappropriate or to otherwise be in violation of these Official Rules (including but not limited to the prohibitions set forth in this paragraph), the Game Photo in question will not be posted for public viewing in the online gallery. If you are not the photographer of the Game Photo submitted in participating in the Game, you must obtain the photographer’s written consent beforehand (with award of prize being contingent upon provision of satisfactory proof of such consent).
Use of Game Photos and Name: By submitting a Game Photo, participant: (a) grants a license to Sponsor and its agents to use participant’s name (first name, last initial) on the Sponsor’s websites (including www.skinnycow.com/wocavewin), or any other website related to the Game, or to use the Game Photo at any time or times, in any media, and entrant shall have no right of notice, review or approval of any such use of the Game Photo, and/or his/her name; and (b) acknowledges and agrees that the Game Photo and/or his/her name, image or likeness may be used in whole or in part, alone or in combination with other works, and that the photo may be changed, altered, edited or modified, used in distorted, illusory or composite form, or in any other manner, as solely determined by Sponsor (other than for the Game itself). Participant further agrees that nothing herein in any way obligates Sponsor to make any use of his/her Game Photo and Sponsor’s failure to use the Game Photo shall not result in any liability to Sponsor. Participant also acknowledges and agrees that the relationship between himself/herself and Sponsor is NOT confidential, fiduciary or otherwise special and that Sponsor has wide access to ideas, stories, designs, concepts and other literary/artistic materials submitted to it by outside sources or being developed by its own employees (and/or third parties working on Sponsor’s behalf) and that such ideas/stories/designs/concepts/literary/artistic materials may be competitive with, similar to (or even identical to) the Game Photo submitted by participant; and, participant agrees that Sponsor and its agencies shall have no liability in conjunction with same.
By entering, each participant represents and warrants that:
(i) the Game Photo is the sole, exclusive, and original creation of participant and has not been copied in whole or in part from any other work with the sole exception of free Game Photo; and (ii) the Game Photo does not violate or infringe any copyright, trademark/trade name, logo, or intellectual property right, other proprietary right of any person (including but not limited to rights of privacy or publicity or portrayal in a false light), or entity (in the case of free Game Photo, if free Game Photo was taken from a website other than www.skinnycow.com, such taking of the free Game Photo did not violate the rights of the website owner), such that Sponsor and its designees can use the Game Photo in the manner set forth above without violating the rights of any third party and,
(iii) the Game Photo (except for free Game Photo) is the sole and exclusive property of participant; and,
(iv) the Game Photo has not been submitted to any other competition, sweepstakes or promotion (for free Game Photo, the free Game Photo has not been submitted by the participant to any other competition, sweepstakes or promotion).
Sponsor grants participants the limited, non-exclusive and non-transferable right to photograph the SKINNY COW brand packaging/logo (and/or to use a free Game Photo available from www.skinnycow.com) solely for purposes of participation in the Game without modifying any SKINNY COW brand trademarks, with the express acknowledgment that any other use of the SKINNY COW brand packaging/logo (or free Game Photo) constitutes an actionable violation of Sponsor’s property rights in same. These rights will automatically expire at the end of the Game.
GRAND PRIZE DRAWING ENTRY: Entrant will automatically receive one (1) entry into the Grand Prize drawing for each valid instant win Game Play. See Grand Prize drawing details below.
Limit: One (1) Game Photo entry/Game Play per person, per valid e-mail address/mobile phone number per day during the Promotion Period. Game ends 11:59pm PT on 6/30/2013. All participants must have a valid e-mail address and/or mobile phone number to play. Each person may only use one (1) e-mail account to participate in this Game. In case of dispute as to the identity of a winner, entry/Play will be declared made by the registered user (meeting eligibility criteria) of the e-mail account/mobile phone number and, if a prize is won, it will be awarded to that registered user. Any participant who uses more than one (1) e-mail account to enter this Game may be disqualified and any prizes won may be forfeited, subject to Sponsor’s sole discretion. In addition to disqualification and prize forfeiture, such conduct may constitute fraud (and Sponsor reserves the right to take any and all necessary and appropriate actions so as to protect its rights).

Two thousand one hundred and thirty-two (2,132) Bronze WoCavé Prizes: A WoCavé Wall Decal, and one box of SKINNY COW candy OR a package of SKINNY COW frozen treats (6-count or less); awarded in the form of a VIP coupon good for one (1) free package, up to $5.00 (total ARV $9.00 for each Bronze WoCavé Prize ); Two thousand one hundred and thirty-one (2,131) Sweetest Treat Prizes: A box of SKINNY COW candy OR a package of SKINNY COW frozen treats (6-count or less); awarded in the form of a VIP coupon good for one (1) free package, up to $5.00 (total ARV: $5.00 for each Sweetest Treat Prize); Coupon prizes are awarded at Sponsor’s sole discretion. Candy coupons will be awarded to residents of CA, CO, LA, NV, TN, and other states whose dairy discounting regulations restrict or prohibit awarding of an ice cream product coupon. ARV OF ALL INSTANT WIN PRIZES: up to $151,467.
The actual odds of winning an instant win prize depend on the total number of eligible Game Plays and submission time of your Game Play. A potential instant winner will be the first person to play the Game on or after the randomly selected time. Prizes will be awarded in the order in which they become available in accordance with the Game technology. Potential winner must comply with all terms and conditions specified by the issuer of prize. Grand Prize Drawing Prize:
One (1) GRAND PRIZE Winner will receive a ten thousand dollar ($10,000) check to be used towards the cost of one (1) room makeover to create his/her own WoCavé or for any other use. Grand Prize Winner will also receive one (1) of each of the following WoCavé items: pink Mini Freezer, micro-suede “Ottowoman,” Memory Board, hammered metal Candy Bowl, WoCavé Wall Decal. In addition, Grand Prize winner will receive five (5) boxes of SKINNY COW candy OR five (5) packages of SKINNY COW frozen treats (6-count or less); awarded in the form of a VIP coupon good for five (5) free packages, up to $5.00 each. Total ARV: $10,604. TOTAL ARV OF ALL PRIZES: up to $162,071.
