OFFICIAL RULES

NO PURCHASE NECESSARY TO PLAY OR WIN. OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE AND OLDER AND WHO ARE PHYSICALLY LOCATED AND RESIDE IN THE FIFTY (50) UNITED STATES OR DISTRICT OF COLUMBIA.

VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

2. ELIGIBILITY: BIC Back to School Instant Win Game (the “Game”) is open only to legal residents of the fifty (50) United States and the District of Columbia, 18 years of age and older, who are physically located and reside in the fifty (50) United States or District of Columbia at time of entry (“Eligible Participant”). Void where prohibited or restricted by law. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and the respective household members, of BIC USA Inc. (“Sponsor”), its affiliates, subsidiaries, divisions, advertising and promotion agencies and Tenthwave Digital LLC are not eligible to enter. Game is subject to all federal, state, and local laws. U.S. law governs this Game.

The Game is in no way sponsored, endorsed or administered by, or associated with, Facebook. By participating, an Eligible Participant understands that he/she is providing his/her information to the Sponsor and not to Facebook. The information he/she provides will only be used for administration of the Game.

3. GAME TIMING/DESCRIPTION: The Game begins at 12:00:00 AM Eastern Time (ET) on July 22, 2013 and ends at 11:59:59 PM ET on September 2, 2013 (“Game Period”). The Game Period is divided into forty-three (43) separate and distinct daily instant win periods beginning each day at 12:00:00 AM ET and ending at 11:59:59 PM ET (each an “Instant Win Period”) and each Instant Win Period is its own separate and distinct Game. There will be twenty-four (24) prizes awarded during each Instant Win Period throughout the Game Period for a total of 1,032 Instant Win prizes available to be awarded. Unclaimed Instant Win prizes will not be awarded.

4. HOW TO PLAY THE GAME: You may play the Game through the BIC application on the Facebook platform. To access the BIC application, you must go online to www.facebook.com/bicpenpals, “like” the page by clicking on the “like” button, allow the application and watch a short video (participants have the ability to opt out of watching the video). When you click on the “Click here” button, you will then be asked to “share a moment” and describe what moment that you are most looking forward to at Back to School for your children by either filling in the blank fields provided or describing your moment in 140 characters or less. Once you share a moment, click the “Continue” button. You will be asked to complete a one-time Registration Form including your first and last name, address, city, state and ZIP code, email address, telephone number, agree to accept the Official Rules and click the “Submit” button. Once you successfully submit the Registration Form, you will be told whether or not you are an instant winner. If you receive a prize winning message, you are a potential winner of the prize indicated, subject to verification and compliance with these Official Rules. If you do not receive a prize winning message, you are not an instant winner. On your next visit during a later Instant Win Period, you will be required to “share a moment” but you will not be required to complete the Registration Form as your information will be remembered by the Sponsor. Winning messages will be seeded randomly by Sponsor throughout each Instant Win Period via random time-date stamp. Limit one (1) Game Play per person/Facebook ID/email address per day during the entire Game Period. Subsequent Game Plays submitted by the same person/Facebook ID/email address on the same day will be void. Game Play must be completed during an Instant Win Period in order to be valid. Proof of Game Play and/or winning that is generated or provided by an entrant shall not be considered proof of playing and/or winning by Sponsor, including but not limited to, screen shots. Game play must be made by 11:59:59 PM ET each day during the Game Period. Unclaimed Instant Win Game prizes will not be awarded.

5. Registration/Game Plays made with the same or multiple Facebook ID/emails addresses, under same or multiple identities or through the use of any agent or other device or artifice to enter or play multiple times in a day will be deemed void. Incomplete Registration/Game Plays not complying with these Official Rules are subject to disqualification and will be deemed void. Registration/Game Plays that have been generated by a script, macro, bot or any other automated means will be deemed void. Registration/Game Plays that are mechanically reproduced, copied, illegible, incomplete or inaccurate are void. All entries become the property of the Sponsor and will not be returned. Sponsor’s decisions are final on all matters relating to the Game. If a dispute results as to the identity of an Eligible Participant, it will be determined that the Registration/Game Play was submitted by the authorized account holder of the Facebook ID/email address from which the Registration/Game Play is made. For these purposes, the authorized account holder is the natural person assigned to a Facebook ID/email address by Facebook. The promotional website’s database clock will be the official timekeeping device for the Game Releasees (as defined below in Section 10) are not responsible for late, lost, incomplete, illegible, damaged, inaccurate, delayed or misdirected Registrations/Game Plays.

6. WINNER DETERMINATION AND NOTIFICATION: Potential winners will receive immediate notification online, subject to verification of eligibility and compliance with the terms of these Official Rules. Potential winners will receive an email subsequent to online notification. Non-compliance with the Official Rules, or if prize or prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize will go unawarded. Allow 6-8 weeks for delivery of a prize. Limit one (1) Instant Win prize per person, Facebook ID/email address for the entire Game Period. All claimed prizes will be awarded.

7. ODDS OF WINNING A PRIZE: Instant Win prizes are awarded based on random time date stamps on each day of the Game Period. Odds of winning a prize instantly each day will depend upon the actual timing of Eligible Participant’s Game Play and the total number of Game Plays transacted each day during an Instant Win Period.

8. PRIZES: Twenty-four (24) winners will be awarded per day for forty-three (43) days for a total of 1,032 prizes available to be awarded. The exact Prize that is awarded in each Instant Win Period will be randomly determined by the Sponsor in its sole discretion.
